This site provides information about my practice as a private mediator. Nothing on the site constitutes legal advice, and nothing on the site creates a mediator-client, attorney-client, or other professional relationship. Counsel for each party retain their advisory roles throughout any engagement.
Inquiries
Submitting an inquiry through this site, by email, or by telephone does not establish a mediator-client relationship. I run a conflict-of-interest check on every inquiry before substantive response. The web inquiry form is not a confidential channel; confidential or privileged content should not be sent through it.
Engagement
An engagement is established only when I issue an engagement letter, both parties sign it (or, where appropriate, counsel for both sides do), and the conditions of engagement (deposit, calendar holds, and the like) are met. The engagement letter, not this site, sets the terms of the work.
Confidentiality and privilege
Mediation communications conducted under a signed mediation agreement are governed by the confidentiality terms of that agreement and by applicable settlement privilege. The website itself is a public-facing communication channel and is not confidential.

This site may link to publications, professional bodies, or third-party resources. I provide such links for convenience; they do not constitute endorsement. I have no control over, and assume no responsibility for, the content of linked sites.
Intellectual property
The text, layout, design, and trademarks of this site are mine or used with permission. You may browse the site for informational purposes; reproduction or republication of its content beyond fair quotation requires my written permission.
Jurisdiction
I operate this practice as Spenser Bauchman. Bar admissions and panel memberships, where applicable, are listed on the About page. I direct the information on this site to a sophisticated audience in the jurisdictions in which I am engaged. Visitors from other jurisdictions are responsible for ensuring that any engagement complies with the rules applicable to them.
Limitation
To the maximum extent permitted by law, I disclaim all warranties and am not liable for any direct, indirect, incidental, or consequential damages arising from use of the site or reliance on its content.
Changes
I may update these terms. The "Effective" date above changes when they do. Continued use of the site after a change constitutes acceptance of the updated terms.
